Terms of Service
The terms below outline how Engineering Exhibit Generator may be used, what remains your responsibility, and how billing and access are handled.
Acceptance of Terms
By accessing or using the Engineering Exhibit Generator, you agree to these Terms of Service. If you do not agree, do not use the service.
Description of Service
The service is a software tool that helps users generate engineering exhibits and related mapping outputs. It is provided as software only, not as professional engineering services.
Account and Access
App access requires a verified account and an unexpired free trial, an unexpired One-Day Pass, or an active paid subscription. You are responsible for maintaining accurate account information and for purchases handled through Stripe. Access is licensed to an individual user.
Free Trial
The free trial includes all five standard exhibits, unlimited projects, and unlimited exports. Access requires email verification and ends at the end of the calendar day after your original signup date, Eastern time (America/New_York). Verifying your email later or resending a verification email does not restart or extend the trial. The trial ends automatically and does not become a paid plan or create an automatic charge.
One-Day Pass
The One-Day Pass costs $10 USD as a one-time purchase and includes all five standard exhibits, unlimited projects, and unlimited exports. Access starts after successful payment and ends at the end of the following calendar day, Eastern time (America/New_York). For example, a Saturday payment gives access through Sunday; access ends Monday at 12:00 AM Eastern. The pass does not renew automatically or become a subscription. You can buy another pass after it expires.
Pro Subscriptions
Pro Monthly and Pro Annual are recurring subscriptions. Manage payment methods, billing frequency, and cancellations through Manage Billing on the Account Settings page. A free trial or One-Day Pass does not automatically enroll you in Pro.
User Responsibilities
You are responsible for the data you upload, the outputs you generate, and verifying that all outputs are suitable for your project, client, and jurisdiction.
Engineering Disclaimer
The Service is a software tool intended to assist in the preparation of engineering exhibits. It does not provide professional engineering services and does not perform the practice of engineering.
Use of the Service does not create an engineer-client relationship.
All outputs must be independently reviewed, verified, and approved by a licensed Professional Engineer prior to any use, submission, or reliance.
The user assumes full responsibility for the accuracy, completeness, and suitability of any outputs produced using the Service.
No Reliance
Users agree not to rely solely on the Service for engineering decisions, regulatory submissions, design validation, or compliance with applicable laws and regulations.
No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY OUTPUTS WILL BE ACCURATE, COMPLETE, OR ACCEPTED BY ANY REGULATORY AUTHORITY.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HLC ENGINEERING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO USE OF THE SERVICE.
IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER TO THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
Indemnification
User agrees to indemnify, defend, and hold harmless HLC Engineering LLC from and against any claims, liabilities, damages, losses, and expenses arising out of or related to their use of the Service or reliance on any outputs.
Termination
We may suspend or terminate access for misuse, nonpayment, security concerns, or other violations of these Terms.
Changes to Terms
We may update these Terms from time to time. Continued use of the service after updates means you accept the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
